2. The petitioner apprehends arrest in connection with Dumariyaghat P.S. Case No. 129 of 2023 dated 07.05.2023 instituted under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner along with other co-accused persons armed with knife, iron rod, farsa, bhala assaulted the informant due to land dispute.
4. Learned counsel for the petitioner submits that there is case and counter case between the parties. There is land dispute and petitioner is also a Government employee. There is no specific allegation against the petitioner. The injury on the
Patna High Court CR. MISC. No.49737 of 2023(2) dt.11-08-2023 2/2 injured are simple in nature. The petitioner has no criminal antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Dumariyaghat P.S.
