The petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code.

The petitioner is not named in the first information report. One Rambalak Singh died inside the jail. Postmortem was held on the dead body and the doctor found that Rambalak Singh died due to strangulation of his neck. Thereafter all the inmates of ward nos. 3 and 4 are made accused in this case. There is no eye witness of the occurrence. On mere suspicion all the inmates of ward nos. 3 and 4 are made accused. Co-accused Ram Pravesh Rai has already been enlarged on bail in Cri. Misc.

Patna High Court Cr.Misc. No.9112 of 2015 (2) dt.12-03-2015 2/2 No. 17283 of 2014.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Sadar P.S. Case No. 358 of 2013.
