The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 341, 337, 353, 427, 504, 124A of the Indian Penal Code and 17 of C.L.A. Act. The prosecution case in short is that the accused persons forming huge unlawful assembly surrounded the police station and pelted stones on the police personnel. It has been submitted on behalf of the petitioners that the petitioners are in custody since 14.5.2019. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case.

A requisition was filed by the I.O. in respect of the petitioners after a period of four years. General and omnibus allegation has been made against the petitioners. No specific over act has been alleged against the petitioners.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 133/2014.
