JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-12-2021 At the outset, learned counsel for the petitioner submits that petitioner no. 1 namely, Subash Ray @ Subhash Ray has been arrested during pendency of this application, and as such, this application as against him has become infructuous. In view of the above, this application stands dismissed as infructuous as against petitioner no. 1. Heard learned counsels for the petitioners and the State.
Petitioners apprehend arrest in connection with Mashrak P.S. Case No. 408 of 2020 registered for the
Patna High Court CR. MISC. No.4911 of 2021(2) dt.10-12-2021 2/2 offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. There is case and counter case between the parties. Both sides have sustained injuries. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Saran, Chapra in connection with Mashrak P.S. Case No. 408 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
