JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-09-2017 Since all these applications arise out of one case, they are being heard together and are being disposed of by this present common order.
Heard the parties.
These applications, for grant of anticipatory bail, arise out of Biraul P.S. Case No. 344 of 2016, disclosing offences under Sections 147, 148, 341, 323,
3/4 324, 307, 506 and 379 of the Indian Penal Code. There are seven persons, who have been named as accused including these petitioners. Allegedly, apart from the named accused persons, 10-15 unknown persons participated in the offence. Allegedly, all the accused persons assaulted the informant variously. Learned counsel for the petitioners has submitted that most of the injuries have been found to be simple in nature. It has also been contended that the allegation in the First Information Report is exaggerated version of the occurrence, which had taken place, because of petty dispute.
Considering the submission, as above, and the fact that the petitioners have no criminal antecedent, these applications are allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, District-Darbhanga, in connection with Biraul P.S. Case No. 344 of 2016 (corresponding to G.R. No. 795 of 2016), subject to the condition laid down under Section
4/4 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
