The petitioners have filed this application for bail in connection with Madanpur P.S. Case No. 137 of 2014 registered for the offence under sections 147, 148, 341, 323, 337, 326, 307, 353, 427, 435, 504 and 124A of the Indian Penal Code, section 17 of the C.L.A. Act and sections 3 & 4 of the Explosive Substances Act.
As per the allegation in the FIR, 500 persons are said to have blocked the police station and attempted to snatch the arms from the police personnel.
It is submitted by learned counsel for the petitioners that the names of the petitioners transpired in course of
Patna High Court CR. MISC. No.45148 of 2019(4) dt.06-11-2019 2/2 investigation. No incriminating articles have been recovered from possession of the petitioners who are in custody since 11.06.2019. It is further submitted that a number of similarly situated co-accused have been enlarged on bail by order dated 26.03.2018 passed in Cr. Misc. No. 2755 of 2018 and also by order dated 14.10.2019 passed in Cr. Misc. No. 47044 of 2019. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation as also grant of bail to the similarly situated co-accused, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 137 of 2014.
