Learned counsel for the petitioner is directed to remove the defects within four weeks.
The petitioner apprehends his arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 353, 332, 333, 393, 307, 506, 427 of the Indian Penal Code and section 27 of Arms Act.
The petitioner in association of other co-accused is said to have attacked on the police party, who were apprehending coaccused, Ghulam Mustafa. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and the petitioner has two criminal antecedents before filing the present bail application. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Learned

No.48132 of 2022(2) dt.06-12-2022 2/2 counsel for the petitioner further submits that similarly situated co-accused has been granted anticipatory bail by this Court vide Order dated 07.09.2021 passed in Cr. Misc. No. 8679/2021. Learned APP for the State vehemently opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case as similarly situated co-accused has been granted anticipatory bail, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Kishanganj P.S. Case No. 175 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
