JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner happens to be husband of the deceased but the informant has not named the petitioner and in course of investigation, the statement of one, Kavita Devi was recorded and the said witness, specifically, stated that in-laws of the deceased, used to pressurize her to enter into flesh trade and when the deceased refused, she was killed by her in-laws. Therefore, said witness has said nothing against the petitioner. Learned counsel, appearing for the petitioner drew my attention towards Annexure-2 to this petition and submits that the inquiry was made by ASI of concerned police station in respect of death of the deceased and in that course, the children of

Patna High Court Cr.Misc. No.12218 of 2015 (2) dt.24-03-2015 the deceased disclosed that the deceased had consumed poison due to family feud.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nathnagar P.S. Case No. 136 of 2014 to the satisfaction of Chief Judicial Magistrate, Bhagalpur.
