JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 Earlier the petitioners had been granted privilege of anticipatory bail vide order dated 04.05.2017 passed by this Court in Cr.Misc. No.18730/17 with condition that they will surrender before the court below within two weeks from the date of receipt/ production of a copy of this order. But the petitioners could not surrender within the aforesaid time.

However, the present modification application has been filed for extension of time to surrender before the court below. Submission of the learned counsel for the petitioners is that on account of some communication gap between the advocate and the petitioners they failed to surrender before the court below within the specified period. The petitioners no.4 and 5 are ladies

Patna High Court Cr.Misc. No.38511 of 2017 (2) dt.23-08-2017 2/2 and on the laches on the part of the office of the counsel. Heard learned A.P.P. also.

In view of the aforesaid submission and the fact that the lach was on the part of the office of the counsel, let the petitioners surrender within a period of one week from the date of receipt/production of a copy of this order and on their so surrendering, they will be released on bail as per the order dated 04.05.2017 passed in Cr.Misc. No.18730/17.

The order dated 04.05.2017 stands modified to the extent above.
