JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-08-2023 Heard learned counsel for the petitioner and learned counsel for the Bihar Sanskrit Shiksha Board (hereinafter referred to as the 'Board').

2. The petitioner in the present case is seeking a direction to the respondents to correct his name which according to him has been wrongly mentioned on the marksheet of Madhyama Examination as 'Durga Devi' in place of 'Durga Yadav'.

3. In this regard, the paragraphs '194' and '194.1' of the judgment of the Hon'ble Supreme Court in the case of Jigya Yadav (Minor) (through guardian/father Hari Singh) Vs. Central Board of Secondary Education and Others reported in (2021) 7 SCC 535 may be referred to.

4. Learned counsel for the Board submits that the petitioner is seeking such correction after about 19 years. It is, however, submitted that the genuineness of the request of the petitioner shall be considered and thereupon an appropriate decision shall be taken by the Board within a reasonable period.

5. In the aforesaid view of the matter, this writ application is being disposed of with liberty to the petitioner to pursue his remedy before the Board.

6. The Board is expected to look into the request of the petitioner keeping in view the genuineness as well as the materials which may be brought to the notice of the Board and an appropriate decision be taken in this regard within a period of three months from the date of receipt/production of a copy of this order.
