JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner in an accused in a case registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and has been named in the First Information Report by the informant who is the wife of the deceased. Referring to the First Information Report, learned counsel for the petitioner submits that there is absolutely nothing in the First Information Report against the petitioner except a vague suspicion expressed by the informant.

He further submits that in similar circumstance, the other co-accused Laxman Singh has been granted regular bail by this

Patna High Court Cr.Misc. No.9480 of 2015 (2) dt.04-03-2015 P2/2 Court vide order dated 22.01.2015 passed in Cr. Misc. No. 2538 of 2015. He further submits that other co-accused persons have also been granted privilege of bail in different cases. In view of the above, let the petitioner Lorik Baitha be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Motihari Town P. S. Case No. 268/2014. (Chakradhari Sharan Singh, J.) Saif/- U T
