The petitioner seeks bail in Sahebpur Kamal P.S. Case No. 146/2014, registered for the offences punishable under Sections 328, 302/34 of the Indian Penal Code. The petitioner is not named in the FIR. The informant is not an eye witness of the occurrence. The informant suspected that the FIR named accused may have mixed poison in the wine. The informant further disclosed in further statement that the accused persons mixed poison in the wine of the deceased in front of the house of the petitioner.
It appears that the informant herself is not an eye witness of the occurrence.
Ashok Sahani co-accused has already been enlarged on
Patna High Court Cr.Misc. No.10878 of 2015 (2) dt.17-03-2015 2/2 bail. The case of the petitioner stands on better footing. Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount to the satisfaction of the Learned Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S. Case No. 146/2014.
