JUSTICE ARUN KUMAR ORAL ORDER 17-10-2017 Heard learned Counsel for the petitioners and the State. Petitioners apprehend arrest in connection with Banshi PS Case No. 32 of 2017 registered under Sections 149, 323, 363, 366, 366A and 368/34 of the IPC.
The allegation is that all the petitioners kidnapped the minor daughter of the informant for the marriage purpose. Learned Counsel for the petitioners submits that the complainant first had given written information to the Superintendent of Police,which is Annexure 2,alleging that Ravi Kumar kidnapped his daughter on motorcycle. There is no allegation against rest family members and the petitioners are parents, brother and sister of the said Ravi Kumar and latter on by filing this complaint they all have been implicated, however both
Patna High Court Cr.Misc. No.49930 of 2017 (2) dt.17-10-2017 eloped from the place and the petitioners have no role in it. Having considered the said facts and circumstances, the petitioners, namely, Mantu Singh, Rahul Kumar, Monika @ Menka Kumari and Rubi Devi @ Rubi Kumari in the event of their arrest or surrender before the court below within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Jehanabad in connection with Bansi PS Case No. 32 of 2017 subject to conditions as laid down under Section 438(2) Cr.P.C.
