The petitioner seeks bail in connection with Saraiya P.S. Case No. 476/2017 dated 22.12.2017 instituted for the offences under Sections 379, 401, 411, 414, 120(B) and 34 of the Indian Penal Code read with Sections 25(1-b)A , 26 and 35 of the Arms Act.
The local police got a secret information that an attempt is being made to loot the ATM of a particular Bank. On such information, a raid was conducted and all the vehicles, which were parked near the ATM of the said Bank, were intercepted. An attempt had been made by the drivers of the aforesaid vehicles to run away and some of them were even successful but some were arrested.
Patna High Court Cr.Misc. No.39567 of 2018 (2) dt.09-07-2018 2/2 So far as the petitioner is concerned, he is said to have been arrested while sitting in a three wheeler. From his possession, a Nokia mobile telephone has been recovered.
The learned counsel for the petitioner has submitted that all those persons who were found near the ATM have been made accused in this case. The petitioner, in fact, was coming from the house of his relative and for no fault of his, he was arrested. The petitioner does not bear any criminal antecedent and he is in custody since 23.12.2017.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, (West) Muzaffarpur in connection with Saraiya P.S. Case No. 476/2017.
