The petitioner seeks bail in Chautham P.S. Case No. 110 of 2014, corresponding to Sessions Trial No. 8 of 2015, registered for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act. There is allegation against the petitioner that he opened fire which hit on the neck of the husband of the informant. Learned counsel for the petitioner submits that the petitioner is the own brother of Bijay Kumar Mahto the injured. There is land dispute between the parties. Statement of the victim has not been recorded.
Considering the facts that the petitioner opened firing on his own brother Bijay Kumar Mahto who received firearm
Patna High Court Cr.Misc. No.8976 of 2015 (4) dt.22-04-2015 2/2 injury on the neck and the doctor extracted one bullet from the injured and opined that the injury to be grievous in nature, I am not inclined to enlarge the petitioner above named on bail at this stage. Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after six months.
