JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Karghahar P.S. Case No. 167 of 2017 disclosing offences under Sections 328, 304(B),34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

The petitioner no. 1 is the father-in-law and petitioner no. 2 is the mother-in-law of the deceased.

Learned counsel appearing on behalf of the petitioners has submitted that, there is vague demand of golden chain, golden ring and cash of Rs. 50,000/- against all the family members of the husband of the deceased. It has been submitted

Patna High Court Cr.Misc. No.47565 of 2017 (4) dt.04-01-2018 2/2 that there is no allegation that soon before the death of the deceased, there was any demand for dowry.

Considering the fact that there is no specific allegation against these petitioners of demand of dory and the husband of the deceased is already in custody as submitted by the learned counsel for the petitioners, this application is allowed. Let the petitioners, above named, in the event of their arrest of surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Karghahar P.S. Case No. 167 of 2017 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
