JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-08-2016 The learned counsel, Mr. Abhay Shankar Singh for the petitioners and the learned counsel, Mr. Varun Kumar Choudhary for Oriental Insurance Company Limited submitted that in view of the order dated 26.07.2016 passed in CWJC No.5808 of 2016 arising out of the Motor Vehicle Accident Claim Case No.176 of 2011, the petitioners may be permitted to withdraw this Civil Miscellaneous application and liberty may be granted to approach the Claim Tribunal, Samastipur itself by filing application for disbursement of the compensation amount separately to the daughter-in-law of the petitioners namely Lussy Devi in one side and the present petitioners in other side.

In view of the submission of the learned counsel for the petitioners, the petitioners are permitted to withdraw this Civil Miscellaneous application with liberty to file the application before the Court below as directed by this Court in CWJC

Patna High Court C.Misc. No.282 of 2016 (2) dt.17-08-2016 No.5808 of 2016 by order dated 26.07.2016. If such application is filed, the Court below shall dispose of the same expeditiously.
