The petitioner seeks bail in connection with Sessions Trial No. 548 of 2021, arising out of Deep Nagar P.S. Case No. 157 of 2020 dated 11.06.2020 instituted for the offence under Section 341, 323, 302, 34 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The brother of the informant was found dead for which the subject FIR was instituted in which the petitioner has not been named. Suspicion though has been alleged against other four persons, who have been named in the FIR. During the course of investigation, one Sunil, who too has not been named in the FIR was arrested and on his confession, the petitioner is

The petitioner is in custody since 25.01.2021. It has been submitted on behalf of the petitioner that apart from the aforesaid confession, there is no other connecting link between the offence and the petitioner.

Regard being had to the aforestated facts and taking into account the period of custody of the petitioner as also that in all the cases in which he was made accused earlier about which reference has been given in paragraph-3 of the bail petition, he has been granted bail, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Nalanda at Bihar Sharif in connection Sessions Trial No. 548 of 2021, arising out of with Deep Nagar P.S. Case No. 157 of 2020.
