The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
The mother of the deceased made allegation that her daughter Seema Devi married to Surendra Keshari. The daughter of the informant got two daughters and three sons, but the accused persons were torturing her. The informant disclosed that Surendra Keshari, the husband and Rohit, the son of the deceased used to assault her.
It is submitted that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the statement of Sarpanch of the village in para-27 of the case diary, who disclosed
Patna High Court Cr.Misc. No.12640 of 2015 (3) dt.29-07-2015 2/2 that the petitioner had illicit relationship with Seema Devi and both have gone towards the railway line a day before the occurrence, but the Sarpanch did not see the petitioner going along with Seema Devi. Name of the petitioner dragged in the case only on suspicion that the petitioner has got illicit relationship with Seema Devi, although the petitioner is a young boy aged about 23 years and Seema Devi is mother of five children. There is no eye witness of the occurrence.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Railway, Bhojpur, Ara in Buxar G.R.P.
