The petitioner seeks bail in a case registered for the offence under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, while the informant was coming home after closing his shop with other persons, this petitioner alongwith co-accused came on motorcycle and this petitioner is alleged to have fired on informant, but it did not hit him and thereafter, both fled away.
It is submitted on behalf of petitioner that though, petitioner is alleged to have fired, but nobody was hurt and petitioner is in custody since 16.06.2021. Investigation is complete. In paragraph - 3 of the petition, it is stated that petitioner is accused in 12 more cases, but in two cases, he has been acquitted and in rest of the cases, he is on bail.
Patna High Court CR. MISC. No.57821 of 2021(3) dt.24-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur in connection with Siwaipatti P.S.
