JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of her arrest in connection with Fulwaria P.S. Case No. 257 of 2018 registered for the offences punishable under Sections 302, 201, 379, 120B and 34 of the Indian Penal Code.

As per FIR petitioner said to be sister-in-law (Gotni) of the deceased and dead body of deceased was found in the toilet and hands were tied.

Submission of learned counsel for the petitioner is that FIR itself shows that there is allegation against Dewar and he used to steal articles of the deceased and for that there was some altercation between them and petitioner has been made accused because she happens to be Gotni of the deceased. No.44702 of 2019(4) dt.04-11-2019 2/2 informant, who has opposed the prayer for anticipatory bail on the ground that she was also residing in the same house where dead body was recovered from the toilet in suspicious condition. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Fulwaria P.S. Case No. 257 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that she has to co-operate in the investigation, otherwise her bail bonds shall be cancelled.
