1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 303(2), 74, 351(2), 191(1), 191(2), 126(2), 115(2), 109 and 352 of the BNS, 2023.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons came and started making boundary on South side, on objection accused assaulted and petitioner along with Amish tore cloths of Nisha and thereafter the accused persons looted articles, ornaments and Rs. 35,000/-.

4. Learned counsel for the petitioner submits that on account of dispute relating to land, an altercation took place in which both sides assaulted each other. It is further submitted

No.53668 of 2025(2) dt.20-08-2025 2/2 that the allegation of tearing the cloths of Nisha is an exaggerated allegation to give serious colour to the case and the allegation of assault is general and omnibus in nature while allegation of committing loot is ornamental. It is also submitted that petitioner is not a criminal.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Banka P.S. Case No. 455 of 2024 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
