Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 366A, 506 and 34 of the Indian Penal Code and Sections 8 and 12 of POCSO Act. 3.
Learned counsel for the petitioner submits that petitioner has antecedent of one case and is in custody since 165-2024. It is next submitted that the informant alleges that he along with his wife, son and daughter aged about 17 years on 15-2023 had gone to attend the marriage of his sister's daughter, further on 9-5-2023, on the day of marriage, the accused persons including the petitioner had also come to attend the marriage but
Patna High Court CR. MISC. No.50232 of 2024(2) dt.18-10-2024 2/3 they kidnapped his daughter by a Scorpio vehicle, further after two days, he received a call from Umakant who said to get his daughter married to the petitioner or else consequences would follow.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that the victim and the petitioner were in love and they eloped. It is next submitted that though in the FIR, it is alleged that the age of the victim was 17 years but the said allegation has been levelled only to give serious colour to the case, when victim is a major. It is also submitted that victim has not supported the case of the prosecution in her statement recorded under Section 164 of the Cr.P.C. Learned counsel further submits that petitioner and the victim have married and the victim presently is staying with her in-laws.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.50232 of 2024(2) dt.18-10-2024 3/3 satisfaction of the learned trial court where the case is pending/successor court in connection with Agiaon Bazar P.S. Case No. 99 of 2023.
