====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 02-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR of the occurrence of dacoity is against unknown. Petitioner is in custody since 25.03.2019. After disclosure by co-accused, namely, Sandip Kumar Chaurasiya, name of the petitioner surfaced.

Submission is that petitioner was never put on Test Identification Parade nor any incriminating article was recovered from possession of the petitioner. Investigation of the case against the petitioner is already complete. Petitioner is ready to cooperate with the trial.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.47972 of 2019(2) dt.02-08-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Paroo Police Station Case No. 02 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
