JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-394, 302, 412 of the Indian Penal Code. Petitioner is neither named in the first information report nor anything was recovered from his conscious possession and it appears from perusal of the impugned order as well as materials, available on the case diary that name of the petitioner surfaced in confessional statement of co-accused and in course of investigation, some witnesses expressed their doubt regarding the involvement of the petitioner in the present case. The petitioner does not have any criminal antecedent and is languishing in jail custody since 07-03-2016.

No.24579 of 2016 (6) dt.18-11-2016 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rupauli P.S. Case No. 125 of 2012 to the satisfaction of Sri P.K. Bharti, learned Judicial Magistrate-Ist Class, Purnea.
