This application, for grant of anticipatory bail, arises out of Nath Nagar P.S. Case No. 226/2016, disclosing offences under Sections 467, 468, 471, 420 and 406 of the Indian Penal Code.
Allegedly, the informant had given a sum of Rs. 5 lacs to the petitioners as a consideration amount for purchase of land. Petitioner no. 1 is mother of Petitioner no. 2, who is said to have taken the money. It has been stated in paragraph 8 of the application that it is true that the informant had given some money to the husband of petitioner no. 1, who had returned most of the
Patna High Court Cr.Misc. No.48900 of 2017 (2) dt.17-11-2017 2/2 amount and he is ready to return rest of the money. Considering the above stands taken on behalf of the petitioners, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar P.S. Case No. 226/2016, subject to the condition laid down under Section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
