The petitioner apprehends his arrest in connection with Malsalami P.S. Case No. 191 of 2016 registered under Section 302 of the I.P.C. pending in the Court of A.C.J.M.-IV, Patna City, Patna.

Submission is that petitioner is innocent and has falsely been implicated in this case as alleged in the F.I.R. Petitioner is own brother of the informant. Further submission is that the deceased committed suicide herself.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that there is direct allegation of strangulation against the petitioner

Patna High Court Cr.Misc. No.49824 of 2017 (3) dt.24-11-2017 2/2 and the witnesses have also supported the prosecution version. On perusal of different paragraphs of the case diary, it appears that there are sufficient materials showing complicity of the petitioner in the alleged occurrence.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
