2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 109, 126(2), 115, 117 and 3(5) of the BNS.
3. The case of the prosecution is that the petitioner has assaulted with butt of pistol on head of one Kamleshwari Singh due to which he received injury.
4. Learned counsel for the petitioner has submitted that the injury received by Kamleshwari Singh is simple in nature. The petitioner is in judicial custody since 14.04.2025.
5. Learned counsel for the informant has opposed the
Patna High Court CR. MISC. No.45766 of 2025(3) dt.16-09-2025 2/2 bail of the petitioner stating that Kamleshwari Singh is an old person aged about 74 years.
6. In any view of the matter, as the injured has received simple injury and only the butt part of the pistol has been used for assault, it shows the intention of the petitioner.
7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nayagaon P.S. Case No. 62 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai.
