This is an application in a case of misuse.
The petitioner is accused in a case registered for the offences punishable under Sections 341, 323, 307, 302 and 504/34 of the Indian Penal Code.
The specific accusation of assaulting with Khanti to the informant and the deceased is against Shyamsundar Sharma and considering the above facts the petitioner was granted bail vide order dated 15.02.2012 passed in Cr. Misc. No. 5087 of 2012. Thereafter the petitioner made default and ultimately the bail bond of the petitioner was cancelled on 23.01.2013 and after about two years and seven months the petitioner was arrested on
Patna High Court Cr.Misc. No.2376 of 2016 (2) dt.29-06-2016 2/2 19.09.2015.
It is submitted by learned counsel for the petitioner that now the petitioner will appear regularly before the learned court below and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. There is nothing on the record to suggest that after the arrest of the petitioner the trial has proceeded any further. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Araria in connection with Sessions Trial No. 1338 of 2012 arising out of Narpatganj (Basmatiya) P.S. Case No. 138 of 2011. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
