JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Petitioner is languishing in custody since 20.08.2014 in a case registered for the offences punishable under Sections 395, 397, 412 of the I.P.C.
The informant's cash of Rs. 4200/-, mobile and motorcycle were robbed. Subsequently the miscreants left the motorcycle and escaped from the scene. The name of the petitioner sprang up on confession of the co-accused Sanjay Kumar Yadav.
It is submitted by learned counsel for the petitioner that nothing has been recovered from the petitioner nor the petitioner has been put on test identification parade. Moreover the investigation has already been concluded. The statements to that effect have been made in para 8 and 9 of the petition.
Considering the fact that investigation has concluded and the petitioner has not been put on test
Patna High Court Cr.Misc. No.4400 of 2015 (3) dt.02-04-2015 2/2 identification parade, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Madhepura in connection with Singeshwar P.S. Case No. 135 of 2014, Sessions Trial No. 175 of 2014.
Since the petitioner has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial. (Dinesh Kumar Singh, J) Shageer/- U T
