In this case, the petitioner is seeking anticipatory bail in connection with Begusarai Muffasil P.S. Case No. 373 of 2014 registered for offence punishable under sections 147, 148, 149, 341, 307, 323, 324 and 504 of the Indian Penal Code. Allegation has been made that the informant was surrounded and he was punctured including his belly from different angles and that resulted into coming out his intestine, inasmuch, the petitioner is moving before the Court after five years.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner and accordingly his prayer
Patna High Court CR. MISC. No.44733 of 2019(2) dt.22-07-2019 2/2 for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
