JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 01.11.2014 in a case registered for the offences punishable under Sections 457/380 of the I.P.C.

It is alleged that theft was committed in the house of the informant. The petitioner was identified by the informant. The stolen mobile was recovered from co-accused Sumant Kumar Rai who confessed that mobile was given to him by his maternal aunt Binda Kumari. Binda Kumari in her confessional statement though named this petitioner but the stolen jewellary, mobile clothes and other articles were recovered from Rajendra Rai @ Dashrath Rai who is the husband of Binda Kumari.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and the petitioner has been roped in four other

Patna High Court Cr.Misc. No.10716 of 2015 (2) dt.23-03-2015 2/2 cases on the basis of confession of Binda Kumari. Considering the fact that recovery has not been made from the petitioner and the investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan in connection with Raghunathpur P.S. Case No. 109 of 2014.
