JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that Sessions Trial No. 679 of 2014 arising out of Sanhaula P.S. Case No. 45 of 2014 is pending for argument and the trial court has sought two months time to dispose of the aforesaid case.

Learned counsel for the petitioner submits that petitioner is in jail custody since long and as a matter of fact, above stated Sessions Trial No. 679 of 2014 is pending on the stage of argument since last two months and still there is no possibility of disposal of the aforesaid case. I am unable to understand as to when the case is pending for argument, why the trial court is seeking two months

Patna High Court Cr.Misc. No.1686 of 2016 (3) dt.16-03-2016 2/2 time for conclusion of above stated Sessions Trial No. 679 of 2014.

However, taking note of stage of the trial, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 679 of 2014 arising out of Sanhaula P.S. Case No. 45 of 2014 pending in the court of 1st Additional Sessions Judge, Bhagalpur is again rejected and the trial court is directed to dispose of the aforesaid case within three weeks from the date of receipt/production of copy of this order even by taking the hearing of the aforesaid case on day to day basis.
