JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-02-2016 This is a case of misuse of privilege of bail in a case under sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.

The petitioner was granted regular bail by this Court by order dated 2.6.2010 passed in Cr. Misc. No.19339 of 2010. The petitioner misused the privilege of bail for 2 years and odd. Taking into consideration that the petitioner has already remained in custody for about 6 months, he (Bipin Saw @ Patarka) is directed to be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Lakhisarai in Lakhisarai (Kabaiya O.P.) P.S. Case No.586 of 2009 subject to the condition that one of the bailors would be a government servant

Patna High Court Cr. Misc. No.1644 of 2016 (2) dt.10-02-2016 and the other would be his own father. As the case is of the year 2009, the petitioner would not physically absent himself in the court below for two consecutive dates at a stretch till two witnesses are examined in trial.
