Petitioners seek regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, FIR named five accused persons, including these two petitioners, assaulted Manoj Singh by iron rod, iron pipe and pistol.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. There is general and omnibus allegation against these

It is next submitted that as per FIR five persons indiscriminately assaulted Manoj Singh but only one injury was found by doctor in course of treatment. Petitioners claim clean antecedent and are in custody since 12.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, completion of investigation coupled with clean antecedent and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Benipatti, Madhubani in connection with Benipatti PS case No.67/2021.
