Petitioner happens to be husband of the deceased and is languishing in jail custody since 10.1.2015 in a case registered under sections 304B, 120B/34 of the Indian Penal Code. In course of investigation, mother of the deceased as well as some other witnesses admitted this fact that on the day of alleged occurrence, petitioner was not present at his home and he had gone outside the village in connection with his livelihood. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Azamnagar P.S. Case no. 296/2014.
