The petitioners apprehend their arrest in connection with Supaul P.S. Case No.162 of 2017 registered under Sections 147, 148, 149, 341, 342, 323, 332, 333, 307, 353, 431, 427 and 504 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Supaul.
The accusation is that on 17.03.2017 at about 03.00 P.M., the informant being the Circle Officer, Supaul, alongwith other police officials of Supaul Police Station reached to remove the encroachment on the side of the Government road and canal in
Patna High Court Cr.Misc. No.57635 of 2017 (2) dt.19-12-2017 2/2 village-Chakla Nirmali, in compliance of the order passed in Encroachment Case No.02 of 2015-16. In that course, both the petitioners alongwith 100-150 unknown persons came there and damaged the Government vehicle and also the vehicle hired for that purpose. They also blockade the road by putting the fire and confined the informant and the police officials for about three hours.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. However, the petitioners are directed to surrender before the trial court and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
