The petitioner has been arrested in connection with Neemchak Bathani P.S. Case No. 120 of 2014 registered for offence under Sections 498A, 366(A) and 376 of the Indian Penal Code.

In view of the statement of the victim it is apparent that she was called by the petitioner on pretext of having break fact and took her in temple and forcibly married with her and took her to his house. However she has stated in the same statement that petitioner is happens to be Jija did not forcibly committed rape upon her it was done out of her own sweet will. Learned counsel for the petitioner submits that victim is aged about 19 years and there is no consent of rape is made out. The petitioner is jail custody since 13.10.2014. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Kumari
