The petitioner seeks bail in Kesariya P.S. Case No. 32/2014 registered for the offence under Section 328, 395 of the Indian Penal Code.

The petitioner Bikram Ram is not named in the FIR. The name of the petitioner figured in the confessional statement of Bhola Kumar. The looted sugar bags were recovered from the house of Ashok Singh, except confessional statement there is no tangible material to show the involvement of the petitioner in the alleged crime. The petitioner has got criminal antecedent, but the petitioner is in jail since 28.06.2014. The petitioner has not been put on Test Identification Parade and the co-accused Krishna

Patna High Court Cr.Misc. No.9327 of 2015 (2) dt.13-03-2015 Sah has already been granted bail.

Considering the facts aforesaid the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sri Dwijendra Kumar, Learned Judicial Magistrate 1st Class, Sadar Motihari, East Champaran in connection with Kesariya P.S.
