Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 341, 323, 366A, 370, 120B, 504/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that three accused persons are alleged to have kidnapped three minor sisters. The victims in their statement have alleged that the petitioner and others took them on inducement, however nothing took place against them. Co-accused Ritesh Kumar Bharti has already been allowed bail by a co-ordinate Bench of this Court.

Considering the nature of material and completion of investigation, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.2649 of 2021(5) dt.26-07-2021 2/2 bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kharagpur P.S. Case No. 406 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
