Petitioner Pappu Kumar seeks bail in a case under Section 302 and other sections of the IPC.
The petitioner is not named in the first information report. The informant alleged that the miscreants entered into his house, assaulted him and also shot his son.
It is submitted that during the course of investigation, on mere suspicion, the petitioner was arrested as his mobile was found around the house of the informant. It is also submitted that the house of the petitioner is situated by the side of the house of the informant. The informant has not named the petitioner. After 25 days of the occurrence, the informant made a statement and alleged that the petitioner has also conspired in killing his son and committing dacoity. There appears that there is no specific allegation against the petitioner. Except confessional statement, the police did not collect any tangible evidence to show the involvement of the petitioner in the alleged occurrence.
Patna High Court Cr.Misc. No.7242 of 2015 (3) dt.15-04-2015 Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M, Sherghati, Gaya in connection with Imamganj P.S.Case No.83 of 2014.
