The petitioner is in custody since 30.01.2015 in connection with Saharsa P.S. Case No. 86 of 2014 registered for the offences punishable under Sections 406, 409, 467, 468 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the present case bearing Saharsa P.S. Case No. 86 of 2014 has been registered specifically taking the name of the petitioner as being the person who left behind a yellow colour plastic bag which was referred to in Saharsa P.S. Case No. 82 of 2014 for the same offence.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.12235 of 2015 (2) dt.26-05-2015 2 / 2 pursuant to the petitioner's name having been taken in Saharsa P.S. Case No. 82 of 2014, the petitioner has already been granted regular bail by this Court in Cr. Misc. No. 11970 of 2015 vide order dated 09.04.2015.

Since the present prosecution also arises out of the same occurrence for which earlier a case had been registered and in whch the petitioner has already been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Saharsa P.S. Case No. 86 of 2014, corresponding to G.R. No. 358 of 2014.
