JUSTICE SANJAY PRIYA ORAL ORDER 3/ 09-11-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners apprehend their arrest in Banka P.S. Case No.418 of 2017 instituted for the offence under Section(s) 341, 147, 323, 324, 325, 307, 427 Indian Penal Code and Section 3⁄4 of the Explosive Substance Act pending in the Court of the Chief Judicial Magistrate, Banka.

As per written report, these petitioners along with five other unknown persons caused injury to the Informant with bomb. Injury report has been annexed as Annexure-2, from which it appears that total six injuries have been sustained by the Informant. Injury No.6 is multiple burn spot over chest and abdomen.

Patna High Court Cr.Misc. No.50739 of 2017 (3) dt.09-11-2017 2/2 Counsel for the Informant has submitted that there is criminal antecedent of the Petitioner No.1 and he is accused in Banka P.S. Case No.586 of 2015.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
