JUSTICE SANJAY PRIYA ORAL ORDER 23-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Mahila (Banka) P.S. Case No. 21 of 2017 instituted for the offence under Sections-376, 323, 504, 506 of the Indian Penal Code and Section 4/8 of POCSO Act. It is alleged in the written report that while the informant, aged 13 years, was working in her house and her brother was sleeping, petitioner entered into her house and caught hold her from back and committed rape with her, on account thereof, bleeding started from her private part and pain in breast. The Panchayati was held in which it was decided to marry the informant with the petitioner but the petitioner refused. The girl has been medically examined wherein her age has been assessed below 18 years.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. His such prayer stands rejected in
