The petitioner apprehends his arrest in connection with Kamtaul P.S. Case No.55 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code. The petitioner alongwith other co-accused persons are said to have assaulted the informant by means of lathi, danda and farsa. It is also alleged that the accused persons after opening the lock of box took away Rs.20,000/- and one Mangal Sutra.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got one criminal antecedent as

Patna High Court CR. MISC. No.47739 of 2022(2) dt.06-12-2022 2/2 stated in paragraph-3 of the bail application. It is further submitted that similarly situated other co-accused persons have already been enlarged on anticipatory bail by this Court vide order dated 29.11.2022, passed in Cr. Misc. No.43794 of 2022. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga in connection with Kamtaul P.S. Case No.55 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
