Petitioner being the husband of informant is languishing in custody since 21.09.2015 in a case registered for the offences punishable under Sections 498A, 323, 307/34 of the Indian Penal Code.

The basis accusation is of torture. It is further alleged that petitioner used to assault the informant. It is submitted by the learned counsel for the petitioner that there is no injury report on the record. Petitioner is ready to keep the informant as wife with due dignity and honour. Statement to that effect has been made in para-11 of the petition which reads as follows:- "That the petitioner is always ready to keep his wife with full dignity and honour of his society."

Patna High Court Cr.Misc. No.2223 of 2016 (2) dt.14-01-2016 Considering the nature of accusation, present stand of the petitioner and investigation being concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Balrampur P.S. Case No. 94 of 2015.
