JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Narpatganj P.S.Case No. 252 of 2016 registered for the offences under Sections 149, 302 and 504 of the Indian Penal Code. Allegation against the petitioners is of assault to the mother of informant causing her death.
Submission of learned counsel for the petitioners is that there is general and omnibus allegation against 18 accused persons, including the petitioners and some of them have been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No. 36839 of 2017, vide order dated 12.9.2017 and case of the petitioners stands on similar footing.

In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S. Case No. 252 of 2016, G.R.No. 2549 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
