Petitioner is not named in the First Information Report and in course of investigation, the victim was recovered and her statement was recorded under section 164 of the Cr.P.C. The victim stated in her statement that one Rubi Kumari took her and kept her in the house of her friend Arunati Kumari, who happens to be mother of the petitioner. The victim has not even whispered a single word against the petitioner in her statement recorded under section 164 of the Cr.P.C.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.1797 of 2016 (2) dt.18-01-2016 2/2 two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st class, Patna in connection with Kadam Kuan P.S.Case No. 264 of 2015.
