JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ariyari P.S. Case No. 104 of 2017/ G.R. No. 860 of 2017 for the offences punishable under sections 406, 409, 420, 467, 468 and 471 read with section 34 of the I.P.C.

Allegedly, irregularities were found in nine Schemes under Manrega and the allegation against the petitioner is that he being the Programming Officer in conspiracy with other coaccused acted illegally resulting fake job cards were prepared. Submission is of false implication and that the

No.52309 of 2017 (2) dt.09-11-2017 2/2 petitioner was posted as Programming Officer at Hussainganj Prakhand, the petitioner has got no concern in preparing the job cards, in this case other co-accused, namely, Alok Kumar, Narendra Kumar, Pradeep Kumar, Rajesh Kumar, Md. Aslam Hussain and Devanand Kumar have already been allowed prearrest bail by different co-ordinate Benches of this Court and as such the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M, Sheikhpura in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
