25-03-2015 Heard Sri Surinder Kumar, learned counsel for the petitioner and Sri Raj Ballabh Singh, learned A.P.P. The present petition has been filed with a prayer to modify order dated 03-03-2015 passed in Cr. Misc. No. 49414 of 2014 to the extent of expunging the word "1st Addl. Sessions Judge, Chapra" and in that place, the word "Shri P.K. Choudhary, Judicial Magistrate, Chapra" may be substituted. Learned counsel for the petitioner submits that due to inadvertence, in prayer portion of the main petition, in place of mentioning the name of Sri P.K.Choudhary, Judicial Magistrate, Chapra, it was incorrectly typed as 1st Addl. Sessions Judge, Chapra.

In view of the facts and circumstances, order dated 03-03-2015 passed in Cr. Misc. No. 49414 of 2014 is modified to

Patna High Court Cr.Misc. No.12803 of 2015 (2) dt.25-03-2015 2/2 the extent that in place of "1st Addl. Sessions Judge, Chapra", it may be read as "Sri P.K. Choudhary, Judicial Magistrate, Chapra. The petition stands allowed.
